Terms of Service & EULA

1. User-Generated Content (UGC) & Zero Tolerance Policy

Opoly allows users to create events, send messages, and upload images. We have a zero-tolerance policy for objectionable content and abusive behavior. You agree NOT to post or transmit content that is:

• Defamatory, abusive, harassing, or threatening.
• Sexually explicit, pornographic, or containing nudity.
• Promoting violence, hate speech, or illegal activities.

2. Content Moderation & User Blocking

• Flagging & Reporting: Users can flag inappropriate content or report abusive users directly within the app.
• Action Window: Opoly moderators will review reported content within 24 hours of submission.
• Removal & Bans: Any content deemed objectionable will be removed immediately. Users who violate these terms will face permanent suspension from the platform.
• Blocking: You have the ability to block any user within the app, which immediately prevents them from contacting you or viewing your events.

3. Assumption of Risk & Indemnification (CRITICAL)

Opoly is solely a software platform that facilitates digital communication. We are not an event organizer, host, or security provider.

• You acknowledge that attending in-person events organized by other users carries inherent risks (including property damage, bodily injury, or emotional distress).
• By using Opoly, you agree to assume all risks associated with interacting with other users offline.
• You agree to indemnify, defend, and hold harmless RoJet Platforms, its founders, and affiliates from any claims, liabilities, damages, or expenses arising from your attendance at an event or your interactions with other users.

4. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use Opoly.

5. Intellectual Property

You retain ownership of the content you post, but grant Opoly a worldwide, royalty-free license to host, display, and distribute it for the purpose of operating the Service.

6. Limitation of Liability & "As-Is" Warranty

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by law, RoJet Platforms shall not be liable for any indirect, incidental, special, or consequential damages (including data loss or service downtime) arising out of your use of the Service. RoJet Platforms does not guarantee any specific outcomes, relationships, or event quality from using the app.

7. Explicit Waiver of Background Checks & Health Risks

Opoly does NOT conduct criminal background checks, sex offender registry checks, or identity verification on its users. You are solely responsible for taking appropriate safety precautions. Furthermore, by attending an in-person event, you assume all risks related to illness, infectious diseases, or pandemics. RoJet Platforms is not liable for your health or safety at any real-world gathering.

8. DMCA & Copyright Infringement

Opoly respects intellectual property rights. If you believe a user has uploaded content (such as an event flyer) that infringes on your copyright, please contact us at copyright@opoly.app with a formal DMCA takedown notice. We reserve the right to terminate the accounts of repeat infringers.

9. Dispute Resolution, Arbitration, & Class Action Waiver (CRITICAL)

By using Opoly, you agree that any disputes or claims arising out of your use of the Service will be resolved by binding, individual arbitration, rather than in court. You explicitly waive your right to participate in a class-action lawsuit or class-wide arbitration against RoJet Platforms.

10. One-Year Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of Opoly must be filed within ONE (1) YEAR after such claim or cause of action arose, or it will be permanently barred.

11. Right to Modify, Terminate, & Ban

Opoly reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We reserve the absolute right to terminate or suspend your account, without liability or refund, for any reason, including violation of these Terms or behavior deemed detrimental to the community.

12. Export Controls & Sanctions (App Store Requirement)

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable (such as the arbitration clause), the remaining provisions of these Terms will remain in full force and effect.

14. Apple & Google App Store Disclaimers

If you downloaded Opoly from the Apple App Store or Google Play Store, you acknowledge that these Terms are concluded between you and RoJet Platforms only, not with Apple or Google. Apple and Google are not responsible for the Service, its content, or providing maintenance and support services. Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you.
